John Miller (“johncharlesmiller”, “we”, “our”, “us”) sells original works of art through the website www.johncharlesmiller.com(the “site”). The Terms and Conditions and Privacy Policy set out below govern your use of this site. By using this site you are agreeing to the Terms and Conditions and Privacy Policy.
Ownership of Content – Intellectual Property:
The materials contained in this site are protected by United Kingdom copyright law with all rights reserved, and all other applicable laws of the United Kingdom and/or England and Wales. John Miller has the exclusive intellectual property rights to all photos, images, text, podcasts and any other material or content included on this site.
Purchasing Policy:
On completion of your order you will be sent a verification email. We will make reasonable efforts to ship the artwork to you within 14 days of the order being placed and payment received. When your artwork has been mailed, you will be sent an email notification of shipping that includes the delivery tracking number (if available). Risk and ownership passes to you when johncharlesmiller has mailed the artwork to you.
Working on Commission – Individually commissioned pieces of artwork:
These require a 20% deposit on booking and payment of the balance of the agreed price plus postage and insurance on completion (prior to delivery). The work will be packaged and sent when full payment has been received.
Fulfilling Orders:
This site collects and retains information related to transactions carried out on this site for the purpose of fulfilling orders, including your name, phone number, email and address. This site uses third party e-commerce payment processors Paypal (“payment services”). When using these Payment Services, they collect and store personal information required to complete the purchase, as outlined in their Privacy Policies.
Pricing:
Prices shown are in Pounds Sterling. Prices do not include delivery, insurance and handling charges. Prices are subject to change. Images of products shown without any advertised price beside that image are not offered for sale. We reserve the right to correct any errors published on the website.
Payments – PayPal eCommerce Payment Processor:
The johncharlesmiller online artwork website accepts all major credit cards. Payments are taken via PayPal, providing a secure gateway for processing transactions. Payments through PayPal can either be made with an existing PayPal account, by registering for PayPal, or by simply entering your card details. Payments made through a third party payment processor Paypal are processed subject to the third party’s Terms of Service and Privacy Policy. In making your purchase, you agree to pay us, through the payment processor, the full amount as charged.
Third Party Services:
As set out above, this site uses third party services, applications or sites, that make available their content and services. When you access those third party services, applications or sites, you are bound by the terms and policies of the third party.
Customer Complaints:
If there are any issues or discrepancies with your order, you shall notify us within 7 days of receipt of your delivery via the “Contact Us” page on our site.
Refunds:
Refunds will not be accepted if it is decided that the artwork is not liked after it has been delivered. Refunds will only be available where the artwork received is not as described on the site in which case the work must be returned within 7 working days undamaged and in its original packaging with insurance.
Returns Policy – Colour:
All reasonable efforts have been made to display the colours of original works of art accurately on this site. However, as individual monitors display colours differently, we are not responsible for colour accuracy. In the event of inconsistencies in colour as you perceive it, you may return the painting (undamaged and in its original packaging with insurance) in exchange for a credit amount of the cost of the artwork to offset against a replacement purchase. In these circumstances, johncharlesmiller will meet the cost of postage and insurance of the replacement artwork.
Governing Law:
These Terms and Conditions are governed by the laws of England and Wales. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms shall be governed, interpreted and construed by the laws of England and Wales.
Disclaimer and Indemnity:
To the extent permitted by law, johncharlesmiller excludes all liability for loss or damage of any kind (however caused or arising) relating in any way to this website. The total liability of johncharlesmiller arising out of or in connection with the web content or these Terms and Conditions will not exceed the cost of resupply of a replacement purchase of the same value plus postage and insurance. If the replacement artwork is more expensive, the difference in price will require to be paid before delivery.
Privacy
Personal Identifying Information:
Your personal information is used only for the purpose of fulfilling orders and customer support. Your personal information is not shared with third parties other than third party service providers for the sole purpose of providing these services.
Customer Support:
When you send emails or other communications, we keep a record of that correspondence. Customer support inquiries are retained in order to provide information or assistance as requested by you.
Newsletters:
This Site offers subscription to a third party newsletter service provider, Mailchimp, to notify subscribers of studio updates, announcements for new work, press releases and invitations to art events. When you sign up for this service you agree to have your name and email stored for the sole purpose of providing this service. Refer to Mailchimp for their terms and conditions and privacy policy.
Third Party Websites:
We advise that you review the privacy policies of other websites you link to from this site so you understand how those websites use, collect and store your information. We are not responsible for the privacy statements or other content on websites outside of this site.
Usage Information:
This site uses Google Analytics. This service is subject to their Terms and Conditions and Privacy Policies. johncharlesmiller has access to the information they collect, for the sole purpose of analysing site usage and performance.
Changes to Privacy Policy:
Any changes we may make to the Privacy Policy will be posted on this page.
Entire Agreement:
These Terms and Conditions and Privacy Policy (which can be viewed at Checkout), constitute the entire agreement between johncharlesmiller and you.
